Participation & Liability Waiver
Covering all classes, courses and programmes for participants aged 3 months to adult.
1. Scope of This Waiver
This Participation & Liability Waiver (“Waiver”) applies to all classes & courses offered under the Calmababy and Calmabody brands, including but not limited to:
- Baby, Toddler & Children’s Swimming Classes (3 months and above);
- Pregnancy Swimming & Aquanatal Classes;
- Postnatal Recovery & Wellbeing Courses;
- Baby Play & Sensory Classes;
- Calmabody Fitness, Yoga & Pilates Classes (adult);
- Any other workshops, events, or programmes run by Calmababy & Calmabody.
By registering for, purchasing, or attending any class or course, the participant (and/or parent/guardian where applicable) confirms agreement to all terms set out in this Waiver.
2. Participant Responsibility & Health Declaration
By attending any Calmababy or Calmabody class, you confirm that:
- You (and/or your child or baby) are in a suitable state of health to participate in the relevant class.
- You do not have any pre-existing medical conditions, injuries, or physical limitations that would prevent safe participation, or that you have sought professional medical advice and been cleared to attend.
- You will inform the class teacher before the session begins of any injuries, health concerns, recent surgeries, or changes in medical circumstances relevant to you or your child.
- You understand that participation in all classes is undertaken at your own risk.
- You accept sole responsibility for ensuring your own suitability to participate, and, where a child or baby is involved, the suitability of that child to participate.
If you are unsure about your or your child’s suitability to attend any class, please consult your GP, midwife, health visitor, or relevant medical professional before participating.
3. Pregnancy & Antenatal Classes
In addition to the general terms above, participants attending pregnancy or antenatal classes confirm that:
- They have received approval from their midwife or GP to participate in aquatic or physical activity classes during pregnancy.
- They will immediately inform the teacher of any complications, symptoms, or changes in their pregnancy.
- They understand that Calmababy & Calmabody teachers are not medical professionals and classes are not a substitute for medical care.
- They will cease participation and seek medical advice if they experience any pain, dizziness, shortness of breath, bleeding, or discomfort during a class.
4. Postnatal Classes & Courses
Participants attending postnatal courses or classes confirm that:
- They have received clearance from their GP, midwife, or health visitor prior to returning to physical activity (typically at the 6–8 week postnatal check for vaginal births, or longer following caesarean delivery).
- They have disclosed any postnatal complications including diastasis recti, pelvic floor dysfunction, wound healing, or perinatal mental health concerns to the teacher.
- They understand that postnatal recovery varies and they will not push beyond their personal comfort or capability.
5. Baby, Toddler & Children’s Swimming Classes
Parents and guardians attending swimming classes with their baby, toddler or child confirm that:
- They accept full responsibility for their child’s safety at all times in and around the pool, including before, during, and after the class.
- They will ensure their child is dressed appropriately with suitable swimwear and a swim nappy where required.
- They will not bring a child who is unwell, has an active ear infection, open skin wounds, or any contagious condition to a swimming class.
- They understand that submersion activities are conducted in a safe, staged, and age-appropriate manner, and they will follow all teacher instructions.
- They will inform the teacher in advance of any medical conditions, allergies (including chlorine sensitivity), or concerns relating to their child.
- Children must be supervised in the water by a responsible adult at all times.
6. Baby Play & Sensory Classes
Parents and guardians attending play and sensory classes confirm that:
- They will supervise their child at all times during the session.
- They are responsible for ensuring their child does not place any props, equipment, or materials in their mouth in an unsafe manner.
- They will inform the teacher of any known allergies or sensitivities (including skin or sensory sensitivities) before the class begins.
- They understand that some activities may use sensory materials (such as water, sand, foam, or paints) and will raise any concerns with the teacher in advance.
7. Participants Under 18 Years of Age
By completing a booking for any Calmababy or Calmabody class on behalf of a participant under the age of 18, the parent or legal guardian:
- Confirms they have read and agree to all terms set out in this Waiver on the minor’s behalf.
- Accepts full responsibility for the minor’s safe participation throughout the class or course.
- Acknowledges that their act of booking constitutes informed consent to participation under the terms of this Waiver.
Baby, Toddler & Parent Classes:
For baby and toddler classes (including parent and child swimming), the accompanying parent or guardian is considered the contracting party and must be present in the water or room throughout the session. Their booking is taken as consent for the child’s participation.
Swim School (Unaccompanied Children):
Children enrolled in Swim School classes attend without a parent or guardian in the water. In this case:
- A parent or guardian must remain on site (in our cafe or the designated viewing area) for the duration of the class and be readily contactable at all times.
- The parent or guardian is responsible for ensuring the child is collected promptly at the end of each session.
- The parent or guardian accepts that the child will be under the supervision of a qualified Calmababy swimming teacher during the session, but that supervision does not transfer parental responsibility.
- Any medical information, health conditions, or concerns relevant to the child must be disclosed to the teacher before the session begins.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Calmababy & Calmabody, its teachers, staff, and representatives:
- Shall not be liable for any injury, illness, loss, damage, or death sustained by a participant or their child during any class or course or while using any associated facilities.
- Shall not be liable for any loss, theft, or damage to personal belongings brought to any class venue or facility.
- Do not accept liability for any pre-existing condition that is aggravated during participation.
This limitation does not apply in cases of death or personal injury caused by the negligence of Calmababy & Calmabody or its employees, or in any other circumstances where limitation of liability is prohibited by law.
9. Photography & Media
Calmababy & Calmabody may take photographs or video footage during classes for use on our website, social media, and promotional materials. You will be notified in advance and may opt out at any time by informing your teacher or contacting us directly. We will never publish images of children without the explicit consent of a parent or guardian.
10. Declaration & Agreement
By signing the Waiver, I confirm that I have read, understood, and agree to all terms set out in this Waiver. I understand that participation in Calmababy & Calmabody classes is at my own risk (and/or at the risk of the child in my care), and I accept the terms of this agreement on behalf of myself and any child for whom I am the parent or legal guardian.
